This agreement is between you and Doron Kaspi and Aaron Thurgood, the independent developers operating under the name Gamut Studio ("we", "us"). It governs your licensed use of Purgatory Guardian, including updates we provide (the "Game").

This agreement applies when it is presented to you and you accept it through the store or the Game. Simply visiting the website does not mean you have accepted it. If you do not agree, do not accept the agreement or use the Game; consult the store about the cancellation or refund rights available to you. If local law requires a parent or guardian to accept on your behalf, they must review and accept it. Applicable store age restrictions also apply.

1. Your license to play

If you lawfully obtain the Game, we grant you a limited, non-exclusive license to install and use it for your personal entertainment, subject to this agreement and the applicable store terms. Store-authorized features, including permitted family sharing, remain available under that store's rules. This license transfers no ownership of the Game's intellectual property to you.

The Game is a single-player game. This agreement does not grant access to unannounced multiplayer, future expansions, or future products. Any account or technical requirements for your edition must be disclosed through the applicable store or Game; this agreement does not itself impose an always-online requirement.

2. Use of the Game and its content

Except where applicable law or a separate permission allows it, you must not redistribute, sell, rent, or sublicense copies of the Game; distribute its assets or soundtrack separately; remove copyright or other ownership notices; or extract and distribute its source code or engine components. You must not bypass license or access controls except to the extent the law permits.

Restrictions on copying, modification, decompilation, and reverse engineering do not apply where the law gives you a right to perform those activities, including applicable interoperability or research exceptions. Nothing here prohibits uses permitted by law, such as lawful criticism or review, or additional permissions we grant separately.

3. Ownership and third-party components

Doron Kaspi and Aaron Thurgood own the rights in the Game that belong to its developers. Other components, including engine technology, software, music, and licensed assets, remain the property of their respective owners. No ownership in those components is transferred to you.

Separate third-party licenses apply where identified for a component. This agreement does not reduce rights that those licenses grant to you. You may use incorporated engine technology only as part of the Game and as necessary for permitted use of the Game; you may not extract and incorporate it into another product unless separately authorized by its owner.

4. Unreal Engine technology

The Game incorporates Unreal Engine code and related Epic engine technology (the "Licensed Technology"). Epic Games, Inc., its affiliates, and their licensors retain their rights in that technology.

To the extent permitted by applicable law, we and those technology providers make no representations and give no warranties or conditions concerning the Licensed Technology, whether express, implied, or statutory. This includes assurances concerning merchantability, suitability for a particular purpose, ownership, non-infringement, uninterrupted operation, or freedom from errors. The Licensed Technology is supplied on an "as is" and "as available" basis.

To the extent permitted by applicable law, we and those technology providers exclude liability relating to the Licensed Technology. These exclusions do not apply to any liability, guarantee, remedy, or other protection that the law does not allow to be excluded or limited. In particular, nothing in this agreement removes your mandatory consumer rights or excludes liability for fraud or other conduct for which an exclusion is unlawful. Epic and its relevant affiliates and licensors may rely on the protections in this section as intended third-party beneficiaries, subject to those same legal limits.

5. Purchases, refunds, and consumer rights

The store from which you obtain the Game handles purchases and any store refund or cancellation process. The store's applicable terms and your mandatory legal rights govern those matters. Contact that store for its purchase support, or contact us for Game support.

Nothing in this agreement excludes or reduces statutory guarantees, rights concerning defective or non-conforming digital content, cancellation rights, or remedies that cannot lawfully be waived. It does not require you to waive those rights when buying, downloading, or playing the Game. Any reference to store terms does not override protections provided by applicable law.

6. Updates and compatibility

We may provide patches or updates to the Game. Store settings may control how they are delivered. Compatibility with particular hardware, operating systems, saves, or third-party modifications can change; consult the information supplied with the relevant update.

This section does not remove any legal obligation to supply updates or maintain conformity. It is not a promise of unlimited future content, perpetual support, or compatibility with every configuration. Changes that require a new agreement will be presented for acceptance where legally required; publishing revised text on this website alone does not change your accepted agreement retrospectively.

7. Privacy and optional analytics

Accepting this license is not consent to optional analytics. The analytics choice is separate, and declining optional analytics does not prevent you from playing. Store and platform services have their own privacy notices. You may contact support without choosing to share optional gameplay analytics.

8. Game warranties and responsibility

Except for promises we expressly make and protections required by law, we do not guarantee that the Game will be free from all errors or compatible with every hardware or software configuration. We will not use this wording to avoid obligations or remedies that applicable consumer law requires.

Any exclusion concerning the Game or its third-party components operates only to the extent the law permits. No part of this agreement excludes or limits liability that cannot legally be excluded or limited, including applicable liability for death or personal injury, fraud, or intentional misconduct. Your mandatory remedies for digital content remain available.

9. Ending the license

You may stop using the Game and uninstall your copy at any time. Ending use does not remove refund or other rights you already have under applicable law.

We may terminate the rights granted by this agreement for a material breach, only as allowed by law. Where the breach can be remedied, we will give reasonable notice and an opportunity to remedy it before termination, unless the law permits immediate termination in the circumstances. On lawful termination, you must stop using the Game under this license. This section does not authorize us to delete your personal files or remove rights the law requires you to retain.

10. Applicable rights and disputes

This agreement does not impose mandatory arbitration, a waiver of collective legal remedies, or an exclusive foreign court. Applicable law determines the law and courts available for a dispute, including any mandatory consumer protections in your place of residence. You may contact us to try to resolve an issue, but doing so is not a condition for exercising your legal rights.

If a provision cannot lawfully be enforced, it applies only to the extent lawful, and the remaining provisions continue to apply where possible. Any change to this agreement must respect existing rights and the legal rules governing contract changes.
